Preparing a Donor Statement

Anyone who is over the age of 18 and is of sound mind can choose to have a Lasting Power of Attorney. When you decide who to appoint as your Attorney(s) it is crucial that you take time to consider very carefully what it is they are required to do. It certainly isn't a job to be taken on lightly. Probably the best people to choose from are those who you know and trust particularly well, family members or friends for example. It is wise to have lots of discussions regarding any personal beliefs, morals, values and your opinions on particular medical intervention.

In part 1 of the Welfare LPA it is possible to make an "advanced decision to refuse treatment" (similar to the ones used in a living will). This allows the Donor to refuse certain types of medical intervention and should be signed and witnessed separately, they are legally binding and can not be over ridden by health care professionals or solicitors at a later date. Examples of this maybe personal opinions regarding certain forms of treatments used to prolong life such as; intravenous feeding, resuscitation etc.

The Financial LPA part one, allows the Donor to place restrictions on what decisions the Attorneys should make. For example; the Donor may not want their home to be sold under any circumstance. It is also possible to advise when the Attorneys should take control over certain areas of the Donors Financial welfare. For example; the Donor may be elderly and not want to bother with the formalities of banking and paying bills etc, this maybe handed over to the Attorney(s) although the Donor is of sound mind.

The Donor is also required to list several names of people who should be contacted once the forms are submitted for registration with the Office of the Public Guardian. The purpose of this is to address any disputes that may arise.
